Regardless of who is at fault for the accident, you are entitled to Statutory Accident Benefits, which are paid for by your automobile insurance company.  A Case Manager may be paid for depending on the degree of injuries suffered.

Ultimately, your Insurance Company must provide you with an application for benefits.  The forms they provide to you are standard in the industry and have time requirements for submission.

Under your own insurance, you have medical and rehabilitation benefits which can be used for physiotherapy, medications, chiropractic treatments, massage, occupational therapy assessments and other rehabilitation assessments and treatments.  If you have been severely hurt, and have been designated catastrophic, your entitlement to medical and rehabilitation benefits is worth more and are available for a longer period of time.

Aside from working with your own insurance company, you may have the right to sue the person who was negligent and caused your personal injuries.  In this case, you would sue the driver and the owner of the vehicle that caused the accident, and certain types of compensation would be sought.  Generally, in a personal injury law suit, the defendant is sued for pain and suffering damages and for those economic losses, such as the past and future loss of income, that are associated to the inability to function as a result of the injuries caused by the accident.
